Get Opinions, Inc. Licensed Application End User License Agreement (EULA)

1. Acknowledgment and Acceptance

This Licensed Application End User License Agreement ("EULA") is an agreement between you and Get Opinions, Inc. ("Get Opinions"). By downloading, installing, or using any application provided by Get Opinions ("Licensed Application"), you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Licensed Application.

2. License

Get Opinions grants you a non-transferable, non-exclusive license to use the Licensed Application on devices that you own or control, as permitted by the usage rules set forth in the Terms of Service and any applicable third-party terms of agreement.

3. Restrictions

You may not:

  • Modify, translate, adapt, or otherwise create derivative works or improvements, whether or not patentable, of the Licensed Application.
  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Licensed Application or any part thereof.

5. Termination

This EULA is effective until terminated by you or Get Opinions. Your rights under this EULA will terminate automatically without notice from Get Opinions if you fail to comply with any term(s) of this EULA.

6. No Warranty

The Licensed Application is provided to you "AS IS" and with all faults and without warranty of any kind. Get Opinions disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

To the extent not prohibited by law, in no event will Get Opinions be liable for personal injury, or any incidental, special, indirect, or consequential damages whatsoever, arising out of or related to your use or inability to use the Licensed Application, however caused, regardless of the theory of liability (contract, tort, or otherwise) and even if Get Opinions has been advised of the possibility of such damages.

The Licensed Application may be subject to US export control laws, including the Export Administration Regulations (EAR). You agree to comply with all applicable international and national laws that apply to the Licensed Application, including the EAR, as well as end-user, end-use, and destination restrictions issued by U.S. and other governments.

This EULA will be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law principles.

10. Entire Agreement

This EULA constitutes the entire agreement between you and Get Opinions regarding the use of the Licensed Application and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
